Background: 

  • HHSC proposes two amendments and new rules for 1 Texas Administrative Code (TAC) Chapter 366 that provide the eligibility requirements for individuals to qualify for presumptive eligibility; the requirements for providers making presumptive eligibility determinations, and HHSC responsibilities for oversight of providers making presumptive eligibility determinations.
  • To align policies and procedures, amendments to existing rules are proposed for qualified entities making PE determinations for pregnant women.
  • A public hearing is scheduled for September 15, 2014 from 2 pm to 4 pm and will be held in the Winters Building, Public Hearing Room, 701 West 51st Street, Austin.
  • The proposed and new rules reference performance standards for making presumptive eligibility determinations.  These standards can be found in the attached State Plan Amendment.  (attached)
